(“Benefit”), sued the Louisiana Commissioner of Insurance in his official capacity;1 the district court granted summary judgment for the Commissioner, holding that the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. §§ 1001 et seq., does not preempt Directive 175, which the Commissioner had issued.
